These Terms of Service ("Terms") govern access to and use of the MailWebhook website, apps, APIs, and related services (collectively, the "Service") provided by IThesion SIA ("MailWebhook," "we," "us," "our").
By creating an account, connecting a mailbox, using the API, or otherwise accessing the Service, you agree to these Terms.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. In that case, "you" and "your" refer to that organization.
1. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Service. You represent that you are legally able to enter into a binding contract.
2. The Service
MailWebhook enables you to connect mailboxes, receive emails, parse or transform email data, and deliver structured payloads to destinations you configure (such as HTTPS webhooks). Service features may change over time.
You are responsible for:
- Your configuration, webhook endpoints, and security of those endpoints.
- Ensuring your use complies with all applicable laws and third party terms.
- All activity that occurs under your account.
3. Accounts and security
You must provide accurate account information and keep it up to date. You are responsible for safeguarding credentials, API keys, and any secrets you store or generate in the Service.
You must notify us promptly if you suspect unauthorized access to your account or mailbox connections.
4. Mailbox connections and authorization
When you connect a mailbox or otherwise provide access to email data, you represent and warrant that:
- You own the mailbox, or you are authorized to access it and to process its contents.
- You have obtained any required consents and provided any required notices to email senders and recipients.
- Your access and processing does not violate the mailbox provider's terms, policies, or applicable law.
You acknowledge that mailbox providers may restrict, revoke, or change API access, and we are not responsible for provider actions.
5. Customer Content
"Customer Content" means content and data you submit to the Service, including email headers, metadata, bodies, attachments, routing rules, and any derived or transformed data.
5.1 Your responsibility for Customer Content
You are solely responsible for Customer Content and for the consequences of processing and transmitting it. You must ensure Customer Content is lawful and that you have all rights and permissions necessary.
5.2 License to operate the Service
You grant us a limited, non-exclusive right to host, process, transmit, and display Customer Content only as necessary to provide, secure, and maintain the Service, and as otherwise permitted by these Terms and our Privacy Policy.
5.3 Sensitive data
Unless we explicitly agree in writing, you will not use the Service to process data subject to heightened legal protections that requires special compliance obligations (for example, regulated medical data, payment card data subject to PCI DSS, or government classified information).
6. Acceptable Use
You may use the Service only for lawful purposes and in compliance with these Terms.
6.1 Prohibited uses
You must not use the Service to do, enable, or facilitate any of the following:
Abuse, fraud, or deception
- Phishing, credential harvesting, impersonation, or social engineering.
- Fraud, scams, deceptive marketing, or misrepresentation.
- Identity theft or unauthorized account access.
Spam and unsolicited messaging
- Sending, assisting, or enabling unsolicited bulk email.
- Running open relays, mail bombing, list harvesting, or address scraping.
- Activities designed to evade filters, blocklists, or enforcement actions.
Malware and exploitation
- Distributing malware, ransomware, spyware, or malicious code.
- Exploiting vulnerabilities, attempting unauthorized access, or probing systems.
Illegal content and unlawful activity
- Any activity that violates applicable law, including laws relating to privacy, surveillance, wiretapping, fraud, or consumer protection.
- Using the Service to traffic in stolen data or credentials.
Privacy violations and unauthorized monitoring
- Processing emails or personal data without a lawful basis or required consent.
- Intercepting communications you are not authorized to access.
Harmful or abusive content
- Harassment, threats, or hateful conduct.
- Content that exploits or endangers children.
Interference with the Service
- Overloading or attempting to disrupt the Service.
- Circumventing rate limits, quotas, authentication, or security controls.
- Reverse engineering or attempting to discover source code except to the extent such restriction is prohibited by law.
Violations of third party terms
- Violating mailbox provider terms, anti-abuse policies, or platform rules.
6.2 Enforcement
We may investigate suspected violations and may take any action we deem appropriate, including:
- Removing or disabling access to content or connections.
- Suspending or terminating accounts.
- Blocking delivery to specific webhook endpoints.
- Reporting to third parties or law enforcement where legally permitted or required.
We may suspend the Service immediately and without notice if we reasonably believe your use creates risk of harm, abuse, legal exposure, or operational instability.
7. Third party services and your destinations
The Service may integrate with third party providers (for example, mailbox providers) and may deliver data to destinations you control (for example, your webhook endpoints).
You are responsible for:
- The security, availability, and correctness of your destinations.
- Any third party services you use in connection with the Service.
We are not responsible for third party services, their outages, or their policies.
8. Fees, trials, and taxes
If you subscribe to a paid plan, you agree to pay the fees described at the time of purchase. Unless otherwise stated:
- Fees are non-refundable.
- We may change prices with advance notice.
- Taxes may apply and you are responsible for applicable taxes.
If you use a free trial, you may be converted to a paid subscription unless you cancel before the trial ends, if applicable.
9. Suspension and termination
9.1 By you
You may stop using the Service at any time. You may cancel your subscription according to the plan terms.
9.2 By us
We may suspend or terminate your access to the Service:
- For a violation of these Terms.
- If required by law.
- If your use creates risk to the Service, other users, mailbox providers, or third parties.
- If you fail to pay fees when due.
9.3 Effect of termination
Upon termination:
- Your right to use the Service ends immediately.
- We may delete or de-identify data according to our retention practices and applicable law.
- Sections intended to survive termination will survive, including payment obligations, disclaimers, limitation of liability, indemnification, and governing law.
10. Intellectual property
We and our licensors own all rights, title, and interest in the Service, including software, documentation, and trademarks, excluding Customer Content.
You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.
11. Confidentiality
"Confidential Information" means non-public information disclosed by one party to the other that is marked confidential or that reasonably should be understood to be confidential.
Each party agrees to protect the other party's Confidential Information and use it only to perform under these Terms.
12. Privacy
Our Privacy Policy explains how we collect and use personal information. By using the Service, you agree to our Privacy Policy.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that emails, attachments, or webhook deliveries will always be successfully processed.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 100 IF YOU HAVE NOT PAID ANY AMOUNTS.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You will indemnify and hold harmless MailWebhook and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service.
- Your Customer Content.
- Your destinations and webhook endpoints.
- Your violation of these Terms or applicable law.
16. Changes to the Service or Terms
We may update the Service and these Terms from time to time. If we make material changes to these Terms, we will provide notice as required by law. Continued use of the Service after changes become effective means you accept the updated Terms.
17. Governing law and dispute resolution
17.1 Informal resolution first
Before starting a formal dispute, you agree to contact us and provide a brief written description of the issue. The parties will try in good faith to resolve the dispute informally.
17.2 Governing law
These Terms and any dispute arising out of or relating to the Service are governed by the laws of the Republic of Latvia, excluding its conflict of law rules.
If you are a consumer habitually resident in the European Economic Area, this choice of law does not limit any mandatory consumer protections you may have under the law of your habitual residence.
17.3 Courts and venue
Business users: If you are using the Service for commercial purposes (not as a consumer), the courts of the Republic of Latvia located in Riga have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
Consumers in the EEA: If you are a consumer habitually resident in the EEA, you may generally bring proceedings in the courts of your domicile and we may generally bring proceedings only in the courts of your domicile, as required by applicable law.
17.4 Injunctive relief
Nothing in these Terms prevents either party from seeking urgent injunctive or equitable relief in any competent court to prevent misuse of the Service, stop unauthorized access, or protect intellectual property.
18. Miscellaneous
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Severability: If any provision is unenforceable, the remaining provisions remain in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Service.
